These Terms of Use (“Terms”) govern your access to and use of itsmysterybox.com and the Mystery Box sweepstakes (together, the “Service”), operated by Steven Hoorfar and Benjamin Gabayan, doing business as Mystery Box (“Mystery Box,” “we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.
Participation in the Mystery Box sweepstakes is governed by our Official Rules, which are incorporated into these Terms by reference. No purchase is necessary to enter or win, and an alternate method of entry is available as described in Section 4(b) of the Official Rules. In the event of a conflict between these Terms and the Official Rules with respect to the sweepstakes, the Official Rules control.
You agree not to misuse the Service, including by attempting to gain unauthorized access, submitting false or fraudulent entries, using automated means to enter, interfering with the operation of the Service, or violating any applicable law. We may suspend or terminate access for any violation of these Terms.
If you opt in to communications, you consent to receive emails and/or text messages from us as described at the point of entry and in our Privacy Policy. Message and data rates may apply. You may opt out at any time by replying STOP to texts or using the unsubscribe link in any marketing email.
The Service and its content, including the Mystery Box name, logos, and design, are owned by or licensed to us and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our prior written permission.
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.
To the fullest extent permitted by law, Mystery Box and its operators and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars ($100).
You agree to indemnify and hold harmless Mystery Box and its operators and partners from any claims, damages, or expenses arising out of your use of the Service or your violation of these Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after an update constitutes acceptance of the revised Terms.
